The board of RAFAKO Company has terminated the contract with the “Memory and Identity” Museum named after St. John Paul II, which is managed by the Lux Veritatis Foundation founded by Father Tadeusz Rydzyk, for the construction of the building and a settlement for the removal of defects. The company demands nearly 25.5 million PLN for the completion of construction and revaluation. The company cited lack of cooperation and even obstruction by the investor as the main reason for terminating the contract and settlement.
Just before the parliamentary elections, the previous board of RAFAKO settled with the “Memory and Identity” Museum, which is managed by the Lux Veritatis (Light of Truth) Foundation by Father Tadeusz Rydzyk. This allowed for the building to be opened in line with the foundation’s intentions before the election. The Investor simultaneously presented a list of defects supposed to be removed after the opening of the museum. These defects were so insignificant, they did not impact the ceremonial opening of the venue and subsequent events held there in any way.
Despite doubts about the reliability of the defects list, Rafako agreed to remove them and to defer the payment of the invoice for the final acceptance of the museum facility. Acting in good faith, Rafako also developed a detailed schedule of further works. However, after the election results were announced, the Lux Veritatis (Light of Truth) Foundation ceased cooperating with Rafako entirely and started to obstruct the realisation of obligations taken on by Rafako for the foundation’s benefit.
“The signed agreement was extremely beneficial for the foundation. Mainly because it allowed for the urgent settlement of public aid funds but also accepted a doubtful list of defects and greatly deferred payments despite the handover of the object and additional work. Despite Rafako doing much more for the benefit of the foundation than it was obliged to, and possibly more than it should have, after the election results were announced, the investor stopped cooperating with us,” commented Robert Kuraszkiewicz, President of Rafako.
Rafako does not recognize the previous termination of the contract and settlement by the Lux Veritatis foundation, which manages the “Memory and Identity” Museum named after St. John Paul II. The company’s board is determined to recover the funds due to Rafako and present to the public all circumstances surrounding the construction of the building financed from public funds.
