The Minister of Culture and National Heritage dismissed the existing presidents of the boards of TVP S.A. (Telewizja Polska S.A.), Polskie Radio S.A., and Polska Agencja Prasowa S.A. (Polish Press Agency S.A.), along with their respective supervisory boards. The Minister appointed new supervisory boards for these companies, which, in turn, appointed new management boards.
The necessity for such actions and their justification were outlined in the resolution of the Sejm of the Republic of Poland dated December 19, 2023, regarding the restoration of the legal order and the impartiality and integrity of public media, including the Polish Press Agency.
The decision to dismiss the former authorities and appoint new ones was made at the General Shareholders’ Meetings by the owner of these companies, represented by the Minister of Culture and National Heritage, who has full autonomy in making such decisions.
The protection issued by the Constitutional Tribunal on December 14, 2023, under the auspices of Julia Przyłębska, and in accordance with the written stance of the State Treasury Solicitor General, who legally represents the interests of the State Treasury, is legally ineffective and does not bind either the Minister of Culture and National Heritage or the new management boards or supervisory boards of these companies in any way.
