The SENT system, originally used for monitoring road and rail transport of sensitive goods, will now also include entities from outside Poland. On November 1, 2024, the registration obligation was extended to carriers that do not have a base in the EU member state, Switzerland, Iceland, Liechtenstein, or Norway.
The SENT system was introduced in 2017 and has been gradually expanded since then. The transport of various types of oil, natural gas, chemical products, fuel, alcohol, and cigarettes is subject to mandatory reporting to the system. In 2022, the system began to include imports to Poland and transit through our country of all types of waste.
“Importantly, up until now, the obligation to report transports in the SENT system mainly concerned Polish carriers. In response to protests at road crossings with Ukraine, the Ministry of Infrastructure decided to also include foreign transport companies in this obligation. The aim of the changes is to strengthen control over carriers from third countries in order to eliminate unfair competition and protect the domestic road transport market from illegal practices by foreign entities” explains Maurycy Kieruj, a lawyer at TC Legal Firm.
Who needs to report to SENT?
The obligation to report transports in the SENT system applies to international road transport or cabotage transport. It includes transport executed based on a standard transport permit, a permit from ECMT (European Conference of Ministers of Transport), as well as a cabotage transport permit issued by GITD.
“A notification will also be necessary in the case of international transports, which do not require a permit but are carried out on the basis of other conditions, for example, an agreement between Ukraine and the European Union” – explains the expert from TC Legal Firm.
SENT system notification – what does it include?
The transport notification to the SENT system will have to include data of the foreign entity carrying out this transport, its sender and recipient (including the name of the company and address of residence or headquarters), place and date of commencement and end of transport in Poland, country of loading and unloading, information on whether the transport is being carried out with or without a load, transport document number and permit, country of registration and vehicle registration number, which is performing the transport, and locator number.
“As can be seen from above, the reporting obligation for foreign entities will not only apply to sensitive goods transport, which was originally the domain of SENT, but all types of transports, including those carried out “empty”. Notifications should be made via the platform https://puesc.gov.pl/, and in case of data changes, they should be updated in the system,” explains Maurycy Kieruj.
This is not the end of changes in the SENT system. On January 1, 2025, reporting transports within its framework will also be necessary for carriers performing road transport on the territory of Poland to or from a non-EU country. This obligation will apply to transport companies from the European Union, Switzerland, Iceland, Liechtenstein, and Norway.
