Mandatory shelters, new parking indicators, a revolution in spatial planning or the announced release of land – these are just some of the legal changes that await the residential real estate industry this year. The question is, are these changes heading in the right direction? How do developers evaluate these ideas? The RynekPierwotny.pl portal asked representatives of the largest development companies about these issues.

The development industry is subject to numerous formal legal regulations, while the activities of developers depend on changing requirements and regulations. While we are advocates for amendments that lead to greater transparency and consistency of law, and constitute part of the government’s long-term clear legislative strategy, we recently have been finding ourselves amidst changes that are introduced hastily and without much thought. For example, a top-down coefficient of parking places for apartments built under a special housing act was imposed which paralyzed investments planned in the lex developer mode. This means that development activity carries a lot of risk and the real estate market has been operating in an unstable legislative environment for years.

The end of last year brought changes resulting from the need for the establishment and development of protective structures i.e., shelters, hiding places and temporary refuge. The catalog of investments subjected to the notification of construction work not requiring a building permit was also extended. The ongoing year also promises to be a period of many reforms that will affect the activities of developers in Poland. Changes are being made under the law on electronic deliveries, replacing traditional official correspondence and correspondence through ePUAP. Work is underway to implement the directive on the energy performance of buildings, aimed at improving the energy efficiency of buildings and reducing emissions of greenhouse gases and other pollutants. The so-called “deregulation act” presented by the Ministry of Infrastructure and Construction, which aims to streamline the operation of businesses is also important.

In our opinion, the most significant impact on the real estate market in 2025 will be the new act on spatial planning and development. Under its provisions, municipalities will be required to adopt general plans by the end of the year. The act also introduces integrated investment plans and building infill areas which will determine the possibility of qualifying areas for the issuance of building conditions decisions. This is a significant change, which can be a “game changer” for many lands. Unfortunately, many municipalities have belatedly begun work on general plans and will not manage to implement them on time.

The most critical regulation that could significantly impact the real estate market, primarily residential in Poland, is the so-called “supply act”. This will allow for an increase in the availability of flats on the market, indirectly, should help to stabilize flat prices for a more extended period. Currently, the severely limited availability of land significantly impacts the financial expectations of private individuals who own such land and who receive numerous developers’ offers for specific plots. The current price levels are very high, and remember that the more expensive the plot, the more expensive the apartments.
