Fear has gripped landowners across Poland. Will they still be allowed to build homes on their plots? The upcoming Spatial Planning Act, set to take effect in June 2026, is being called a “true revolution.” It may disqualify many land parcels from residential construction. Faced with uncertainty, property owners are rushing to secure building permits — also known as warunki zabudowy (WZ) — or to sell their land before it potentially loses its building status. “We’re seeing a lot of anxiety. More plots are being put up for sale, often at attractive prices. But buyers must stay vigilant — that cheap land might turn out to be unbuildable,” warns real estate expert Mirosław Król.

A “Real Revolution” in the Making

The new law introduces sweeping changes to spatial planning and construction. Many people are scrambling to finalize permits before it goes into effect. In some municipalities, only a small percentage of land is covered by existing local development plans. That’s why owners are urgently filing applications for WZ permits.

Attorney Marek Jarosiewicz from the Wódkiewicz Sosnowski Jarosiewicz law firm explains:

“The upcoming changes introduce a new type of local legal act — the ‘general plan’ (plan ogólny) — which will be a reference point for all future WZ decisions. Soon, every WZ decision will need to comply with this plan and can only be issued for plots within so-called ‘complementary development areas’.”

He adds:

“If a municipality hasn’t adopted its general plan in time, no WZ decisions can be issued until the plan is in place. Furthermore, WZ permits will no longer be timeless — they will expire after five years.”

The new rules will significantly affect property rights. Some landowners may lose the ability to build on their plots in the interest of greater spatial and architectural harmony.

Should You Buy Now? Proceed with Caution

Jarosiewicz advises prospective buyers:

“If you’re considering buying land, first check whether it’s already covered by a local zoning plan. If not, it’s better to wait until the general plan is passed — or include contractual safeguards in the sales agreement in case zoning rules change.”

Impact on Land Prices: Some Soar, Some Plummet

The new system will create clear winners and losers. Some plots might lose all building potential — and value — while others may soar in price.

“The market is unsettled. Many buyers weren’t aware of the law, and when we explain the risks, they’re shocked. We’re seeing many ‘bargains’ — plots being sold below market price due to owners’ concerns,” says Król.

Municipalities are also struggling to keep up. Applications for WZ decisions have surged, and waiting times have ballooned to several months.

“The chaos in the administrative process is making things worse. As we get closer to the law taking effect, it will only become harder to get a WZ decision,” Król warns.

The months leading up to June 2026 will likely be crucial. For those looking to build, time is of the essence — but so is caution.
