The Ministry of Justice has prepared an amendment to the Criminal Procedure Code that introduces the possibility of electronically sending documents in criminal and misdemeanor cases via an information portal. The new regulations aim to expedite court proceedings, reduce court expenses, and improve communication between parties involved in the proceedings.

Electronic Documents: Who Will Benefit?

The proposed regulations will allow prosecutors, attorneys, legal advisors, and representatives of the Attorney General’s Office to send documents to the court, such as requests for the preparation of a judgment’s reasoning, appeal measures (appeals and complaints), responses to appeal measures, and other documents related to appellate proceedings.

Once a document is sent via the information portal, it will automatically be assigned to the specific case, which will significantly streamline the courts’ work. Parties will no longer need to use traditional postal services or submit documents through court offices to the relevant departments.

Gradual Implementation of New Solutions

The amendment envisions the gradual introduction of the ability to electronically send documents to avoid disrupting the operation of IT systems. In the initial phase, the solution will be available only in criminal proceedings and will then be extended to other types of proceedings.

The regulations will come into force six months after their publication in the Official Journal.

Electronic Delivery of Documents

The amendment also introduces the possibility of electronically delivering documents to the parties involved in the proceedings via the information portal. Parties who opt for this method of delivery will be able to receive documents electronically. Those who do not choose this option will continue to receive documents by traditional mail.

The electronic delivery solution will come into effect one year after the amendment’s publication in the Official Journal.

The Ministry of Justice indicates that this amendment is a step toward the digitalization of the judiciary, which is essential for improving the Polish justice system. This will allow both parties involved in proceedings and court employees to use modern, efficient tools in the justice process.
